ART. 1. ORGANIZER AND REGULATIONS

(1) The organizer of the promotional campaign “BLACK FRIDAY SUMMER EDITION” (hereinafter referred to as the “Campaign” or the “Promotion”) is SARKKROM TRADING S.R.L., headquartered in Bucharest, Sector 1, Calea Floreasca no. 246C, SkyTower Building, 34th floor, units A and A1, registered with the Bucharest Trade Registry under no. J2007006719400 dated 02.04.2007, fiscal code 21493505.

(2) Participants in the Campaign are required to comply with the terms and conditions of these Official Regulations (hereinafter referred to as the “Official Regulations”).

(3) The Official Regulations are drafted and made available to the public in accordance with applicable legislation and may be consulted free of charge throughout the entire Campaign period through the following methods:

  • by accessing the campaign link available on the official website calvinklein.ro;
  • in the participating stores, on the information tablets made available.

(4) The Organizer reserves the right to amend these Regulations during the Campaign period, to suspend or terminate the Campaign, with the obligation to officially inform the public in the same manner as the initial communication, at least 24 hours before the amendments become effective.

(5) Participation in the Campaign implies acceptance of these Regulations by the participants, who are required to fully comply with the established terms and conditions.

(6) Online participants understand and accept that the use of the website may only be carried out in compliance with the Terms & Conditions and after reviewing the Privacy Policy.

 

ART. 2. CAMPAIGN PERIOD AND AREA OF VALIDITY

(1) The promotional campaign will be available for online outlet purchases and in the participating stores in Romania, namely the outlet stores: Calvin Klein Fashion House Militari and Fashion House Pallady, according to Annex 2. Eligible products are listed in Annex 3, an integral part of these Regulations, namely products available in the participating stores, excluding socks, 2024 Collection products and products already benefiting from a discount higher than 44%.

(2) The promotional campaign will take place between 15.05.2026 – 24.05.2026.

(3) After 24.05.2026, Sarkkrom Trading S.R.L. shall no longer bear any responsibility and assumes no obligation in connection with any circumstance that may lead interested persons to believe that the promotional campaign is still valid or ongoing.

(4) All products granted within this promotional campaign must be purchased in accordance with these Regulations; otherwise, the Organizer shall no longer owe them.

(5) The promotion is valid while stocks last.

 

ART. 3. RIGHT TO PARTICIPATE IN THE CAMPAIGN

(1) The promotional campaign is addressed to the general public, to all individuals, both members and non-members of the loyalty program, who are at least 18 years old by the Campaign start date, including Romanian citizens or foreign citizens residing in Romania with permanent residence/residency in Romania, and who accept the terms and conditions of these Regulations (hereinafter referred to as the “Participants”) by making eligible purchases according to the conditions of the promotional campaign.

(2) The Organizer reserves the right to eliminate any fraud attempt by restricting access to this promotional campaign for persons attempting to commit fraud.

(3) By participating in the Campaign, participants express their consent for their personal data to be processed by Sarkkrom Trading S.R.L. in accordance with the provisions of Annex 1 to these Regulations.

(4) Employees of the Organizer may not participate in the Campaign.

 

ART. 4. PARTICIPATING PRODUCTS

(1) The Campaign applies to outlet-priced products from the outlet collection provided under Art. 2 para. (1) of the Regulations, respectively Annex 3, with the explicitly mentioned exclusions, sold by the Organizer in participating stores and online, within available stock limits.

(2) The detailed list of participating products, including exclusions, is part of Annex 3.

(3) The Organizer shall no longer have any liability or obligation towards persons purchasing participating products or placing orders after the Campaign end date (in stores, the Campaign ends at the closing hour of the participating stores, according to the displayed commercial schedule).

 

ART. 5. MECHANISM OF THE PROMOTIONAL CAMPAIGN

(1) The Campaign is addressed to customers who, subject to a minimum purchase of 300 RON (VAT included) of one or more participating products for women and men, according to Annex 3, purchased in participating stores in Romania or through the online platform on calvinklein.ro, will benefit from:

  1. a) for WOMEN’S PRODUCTS purchases: an extra 30% discount applied to the outlet price of the eligible purchased products (OTL);
  2. b) for MEN’S PRODUCTS purchases: an extra 20% discount applied to the outlet price of the eligible purchased products (OTL).

(2) The discount is automatically calculated in the online system upon payment for the participating Campaign products during the campaign period or applied at checkout for in-store purchases.

(3) For the avoidance of doubt, in the case of purchasing multiple products whose value exceeds the minimum purchase threshold, of which only some are eligible, only the value of the eligible products according to these Regulations shall be considered when determining the minimum qualifying purchase value, excluding the value of products not included in the campaign.

(4) The discount applies to a single purchase, on a single fiscal receipt; multiple purchases cannot be combined to reach the minimum participating purchase threshold.

(5) In the event of any website or management system malfunction, including human errors, resulting in the price not being adjusted according to the promotional campaign and the applicable campaign discount, the Organizer reserves the right to cancel the respective order and inform the customer accordingly. The customer accepts and agrees that they shall have no right to oppose or make claims regarding products subject to orders resulting from or containing operational errors, including human errors. Therefore, the Organizer reserves the right to cancel incorrectly placed orders (e.g. derisory prices caused by technical or human errors, etc.).

 

ART. 6. LIABILITY

Participation in the Campaign implies knowledge and acceptance of these Regulations. The Organizer is not responsible for:

  • impossibility to participate due to technical reasons or circumstances beyond its control;
  • stock depletion before the Campaign ends;
  • possible malfunctions of the online platform or IT systems.

 

ART. 7. TERMINATION OF THE CAMPAIGN

(1) The Campaign may end before the scheduled date through unilateral decision of the Organizer or in case of force majeure, with public notification through the same communication channels used at launch.

(2) In the event of campaign termination or modification of conditions communicated to customers through publication on the company website and in participating stores, the Organizer shall have no obligation towards customers for payment of compensation or similar claims.

 

ART. 8. DISPUTES AND APPLICABLE LAW

Disputes between the Organizer and participants shall be settled amicably, and in the absence of an agreement, by the competent courts in Romania, at the Organizer’s registered office.

 

ART. 9. FORCE MAJEURE

Force majeure events exempt the Organizer from liability, according to Art. 1351 of the Romanian Civil Code. Communication regarding the force majeure event shall be made on the official website calvinklein.ro within 5 working days from the occurrence of the event.

 

ART. 10. MISCELLANEOUS

Complaints regarding the Campaign may be submitted through the contact form available on calvinklein.ro until the end date of the Campaign, via email at sarkkrom@sarkkrom.ro, or in participating stores.

 

FINAL PROVISIONS

These Regulations together with their annexes (Annex 1 – Data Protection, Annex 2 – Participating Stores, Annex 3 – List of Participating and Excluded Products) form an integral part thereof. The Organizer reserves the right to amend these Regulations at any time through an addendum, communicated to the public through the same official channels.

ANNEX 1 – PERSONAL DATA PROTECTION (GDPR)

  1. Data Controller

The Organizer acts as data controller in accordance with Regulation (EU) 2016/679, GDPR, for the processing of personal data of Campaign participants.

  1. Purposes of Processing

The personal data collected and used in the context of organizing and conducting the Campaign are processed for:

  • organizing and conducting the promotional campaign;
  • sending commercial communications and marketing materials, such as offers regarding the Organizer’s products, invitations to participate in contests, surveys, questionnaires or other similar communications, with the participant’s prior consent;
  • concluding and performing product purchase agreements;
  • participation in the Campaign, handling complaints and requests from participants, including delivery, invoicing, product returns and dispute resolution;
  • implementation of the Regulations, including court defense or other judicial / administrative proceedings, investigation of potential violations, reporting, analyses and statistical studies regarding the success of marketing campaigns;
  • archiving and data retention activities where required by law.
  1. Legal Basis for Processing

The processing of personal data is carried out based on:

  • the participant’s consent, Art. 6(1)(a) GDPR;
  • the performance of a contract to which the data subject is party, Art. 6(1)(b) GDPR;
  • the legitimate interests of the Organizer, Art. 6(1)(f) GDPR.

Where consent represents the legal basis, data subjects have the right to withdraw it at any time, without affecting processing based on other legal grounds.

  1. Source and Recipients of Data

The data may be disclosed to:

  • the Organizer’s partners, acting as controllers or processors;
  • public notaries and lawyers appointed to assist in organizing and conducting the Campaign;
  • service providers, including courier and mobile telephony services;
  • public authorities or other Group companies, where there is an appropriate legal basis, such as legal obligation, consent or legitimate interest.
  1. Data Retention Period

The data will be retained for the duration of the Campaign plus an additional minimum period of 3 years, corresponding to the statute of limitations for legal actions and according to financial-accounting and legal archiving obligations.

  1. Rights of Data Subjects

Data subjects benefit from the following rights:

  • Right of access – confirmation of data processing and information regarding purpose, categories, recipients and retention period;
  • Right to rectification – correction or completion of incomplete data;
  • Right to erasure – where the data are no longer necessary, consent has been withdrawn or processing is unlawful;
  • Right to withdraw consent and right to object – for processing based on consent or legitimate interest, including marketing and profiling;
  • Right to restriction of processing – in situations such as contesting data accuracy, unlawful processing, or during verification of requests;
  • Right to data portability – receiving data in a structured, commonly used and machine-readable format and transmitting them to another controller, where technically feasible.

ANNEX 2: PARTICIPATING STORES

The promotional campaign shall take place for online purchases on the official website www.calvinklein.ro and in participating stores in Romania, exclusively in outlet stores, namely:  Calvin Klein Fashion House Militari and Calvin Klein Fashion House Pallady. FSS stores are excluded from this promotion.

ANNEX 3: ELIGIBLE PRODUCTS

Eligible products are those belonging to the Women’s and Men's Outlet Collection and selected styles, excluding the products specified in the Regulations.

The full list of eligible products available on the online platform at calvinklein.ro can be consulted throughout the duration of the offer here or by visiting the participating stores and checking the information tablets.

Excluded from the promotion are socks, products from the 2024 Collection, and products already benefiting from a discount greater than 44%.
